Alina Habba leaves her post in the wake of appeals court disqualifies her service.
Alina Habba has stepped down as New Jersey's top federal prosecutor. This follows a legal ruling that questioned her eligibility to hold the office.
Acceptance of Resignation
The head of the Justice Department, the Attorney General, confirmed the prosecutor's departure on the start of the week. She commented that the judicial decision made it impossible for Habba to lead the department effectively.
"Let no one confuse adherence to the ruling as defeat," she wrote. "This battle will now extend throughout America."
Court Ruling
Habba's exit was triggered by a judicial panel ruled that she had been unlawfully serving as US attorney. This ruling is likely to affect numerous criminal cases in the Garden State.
The appellate judges said that a temporary posting that skirted the advice and consent of the Senate breached the federal law governing appointments.
Ongoing Legal Battle
The Attorney General added that she will remain at the DOJ as a senior adviser. She will seek further review of the court's action, with hopes of a different outcome.
In a statement, Bondi wrote that judges "should not be able to countermand the President's choice of prosecutors responsible for executing the executive branch's core responsibility of prosecuting crime."
Performance in Office
The attorney general highlighted Habba's record and said that under her leadership, the state capital of Newark saw a significant drop in criminal activity. She also stated that the city of Camden recorded its first summer in 50 years free from homicides.
Connection to Donald Trump
The 41-year-old attorney, was initially recruited to Trump's personal legal team in 2021. She went on to acted for Trump in his hush-money trial in the previous year, when he was guilty verdict on dozens of charges of falsifying business records.
Before assuming the federal prosecutor position, Donald Trump had announced he was appointing her as his senior adviser if re-elected, labeling her as deeply loyal and a relentless legal advocate.
